McHenry County Staff Plat Review Committee met May 1.

Here is the minutes provided by the committee:

I. CALL TO ORDER

Meeting called to order at: 8:30 AM by Dennis Sandquist.

PRESENT: Colletti, Wallen, Sandquist, Beets, Kolner, Oliver

Motion by Ms. Colletti, seconded by Mr. Beets to approve the minutes.

RESULT: ACCEPTED BY VOICE

IV. SITE PLAN REVIEW

A. John R. Hegner – Petition #2019-007 – Conditional Use Permit to allow for a Bed and Breakfast

Present on behalf of the Petition were John and Rebecca Hegner.

MCDOT COMMENTS - Ray Beets

Mr. Beets noted the property is on a state route, so he does not have any comments. It was noted the petitioners have coordinated with IDOT.

STORMWATER - Joanna Colletti

Ms. Colletti asked that the wetlands be called out on the official site plan. She noted they are shown, but not called out.

ZONING COMMENTS - Kim Kolner

Ms. Kolner noted the proposed parking spaces were outlined on the site plan, but there was no notation in regards to the existing number of parking spaces that are provided in both of the driveways. Both locations will have to be ADA Compliant, and those handicapped spaces are required be noted on the site plan.

Ms. Kolner stated there are concerns with having the conditional use area be two separate legal descriptions and not connected. Because of this, this would require two separate petitions.

If the petitioner's choose to go forward with one request, the legal descriptions need to be connected, so that would mean one legal description containing both of those areas.

Depending on how the petitioners move forward, it should be consistent with the definition of bed and breakfast.

Ms. Kolner explained, if a deed restriction is required, there may be a concern of having two dwelling units even though they are two separate PIN numbers.

BUILDING COMMENTS - Adam Wallen

Mr. Wallen stated the building code has an exemption for a bed and breakfast if there are five lounging units. The way the code is written, it would allow this application to fit under that bed and breakfast. This assumes there are five or fewer guest rooms, and that it is owner occupied. As long as those two requirements are met, you can push back to the IRC Requirements.

HEALTH DEPARTMENT - Charlie Oliver

Mr. Oliver stated this has gone through the Health Department review process. Based on the site plan, there is a trail at the 18810 residence that is going through the septic field. Mr. Oliver stated, if they want a trail through the septic field, they can do a mowed grass trail. Concrete or gravel would not work. It was noted the trail is mowed grass.

Mr. Oliver asked about the parking at the building that has the septic. It was noted there will be no parking on the septic.

Ms. Kolner stated if there is going to be overflow parking, it should be shown on the site plan.

Motion by Ms. Kolner, seconded by Mr. Wallen to approve the site plan based on the comments made today.

All members voted aye, motion passed.

V. STATUSUPDATE

Ms. Kolner stated that Shepherd Capital is still pending, and Lowe went through and will be at next months County Board.

Motion by Ms. Colletti, seconded by Ms. Kolner to adjourn. The meeting adjourned at 9:06 a.m.
