McHenry County Staff Plat Review Board met Oct. 20.

Here are the minutes provided by the board:

I. CALL TO ORDER

Meeting called to order at: 8:33 AM by Adam P Wallen.

PRESENT: Wallen, Hanlon, Beets (Remote), Levato

ABSENT: Colletti

Also present was Kim Scharlow, McHenry County Planning and Development

1. Staff Plat Review - Public Meeting - Oct 6, 2021 8:30 AM

Motion by Mr. Levato seconded by Mr. Beets to approve the minutes.

RESULT: ACCEPTED BY VOICE

IV. SITE PLAN REVIEW

1. #2021-007 - JEMCO Properties, LLC - Riley Twp - A1C-A1C

Present on behalf of JEMCO were: Mark Saladin, Tammy Berlin, Don Greetham and Brian Wozniak. This is a request for a renewal of a conditional use for an existing operation.

Water Resources - Joanna Colletti

Ms. Colletti was not present, but she submitted a memo stating she did not have any comments.

Building Comments - Adam Wallen

Mr. Wallen stated there was construction of a toilet room under a previous permit. He stated the toilet room can be used if it is accessible by the employees.

It was noted the quality control technician uses the room, and there are porta potties on the site. At the most, there are four employees on the site.

McHenry County Department of Health - Jeff Levato

Mr. Levato stated there were two permits related to the scale house, that never got resolved completely. One was for the revised septic drawing. Mr. Levato said he will follow up with the petitioner under separate cover. There was a matter with the well that serves the buildings. It was confirmed that the well was drilled on the neighboring property, and this needs to be resolved.

Regarding the site plan, there should be monitoring wells on the property, and they should be shown on the site plan. If they are going to be abandoned, they will have to be abandoned under a permit.

ZONING: - Renee Hanlon

Ms. Hanlon asked for a history of the CCDD (Clean Construction and Demolition Debris) Facility. Mr. Wozniak stated the facility is operational currently. The facility is approved to take in and dispose of clean construction debris.

It was noted there is an IEPA permit.

It was noted that the CCDD facility has been in operation since 2019. Ms. Hanlon stated in 2011, when the conditional use was last granted, a CCDD Operation Facility was not part of the renewal application.

Ms. Hanlon stated because they are in the SARA overlay, (Sensitive Aquifer Recharge Area) it is concerning and it should be reviewed. The UDO prohibits CCDD operation within the SARA area unless they can show they are meeting all of the IEPA requirements, and there has to be a groundwater monitoring system specific to the CCDD operation.

Ms. Hanlon stated a proposal for the groundwater monitoring system of the area located in where the construction debris is being disposed.

Ms. Hanlon stated a traffic memo addressing the truck traffic would be require before the ZBA Hearing.

A plan for the ground cover, after the final grading should be added to the reclamation plan.

MCDOT - Ray Beets

No comments.

Motion by Ms. Hanlon, seconded by Mr. Levato to approve the site plan pending the addition of the monitoring wells, and resubmitting to staff for verification.

All members voted aye, motion passes.

2. #2021-038 - Anderson - McHenry Twp - A1-A1C

Present on behalf of the petition were David Anderson and his realtor Lori.

Mr. Anderson told the Committee he would like to build a year-round training facility for the throwing club that he runs. It is called the Boas Throwing Club. Mr. Anderson coaches youth athletes in shot put, discus, hammer and javelin.

Mr. Anderson stated at first there will be parking for himself and two volunteer assistant coaches. The barn would be at least ten years in the future.

Stormwater Comments - Joanna Colletti

Ms. Colletti was not present, but her written comments were presented by Mr. Wallen

The proposed impervious area calculation should be shown on the site plan.

The limits of the flood hazard areas should be shown on the site plan.

If any portion of the project is going to impact a flood hazard area, all impacted components of the system shall be constructed of flood damage-resistant materials.

It appears that the proposed future barn will be constructed in the flood hazard area. The petitioner should consider an alternate location or that compensatory storage will be required for any fill in a flood hazard area.

It appears there may be additional wetlands within the development limits near the northwest corner of the parcel. Additional information regarding wetland and buffer limits should be shown on the site plan.

If there are wetlands present on or adjacent the development, the appropriate buffer widths should be shown on the site plan.

BUILDING - Adam Wallen

Mr. Wallen stated until the structure is built, toilet rooms will not be required because it is not constituted as a place of employment. If a storage shed were to be constructed, that will trigger requirements for restrooms.

The location of the of the javelin throwing should be added to the site plan.

Mr. Wallen mentioned this is going to be a commercial operation, and any permit would require an architect.

MCDOT - Ray Beet

Mr. Beets did not have any comments. Pioneer Road is a Township Road.

PLANNING: - Renee Hanlon

Ms. Hanlon stated a 40-foot setback is shown from the centerline of Pioneer Road to the future barn. If you are measuring from the center line, the setback requirement is 65 feet. Ms. Hanlon pointed out that the Stormwater Division may ask for changes to the location.

When looking at the plat of survey, it shows a 60-foot wide right-of-way. Ms. Hanlon asked if that 60- foot right of way exists, and if it does, the site plan needs to show that, and everything needs to be measured off of that lot line.

The petitioner should contact Jim Condon regarding the right of way and the expansion of the parking lot.

Dimensions of parking stalls should be shown on the site plan. The number of required parking spaces for this type of use is one per 250 square feet of area. Ms. Hanlon noted that is a lot of parking. She requested a written parking plan for the ZBA to understand.

There is no requirement for pavement. Gravel is fine, the accessible parking stall is required, that must be paved. The surface materials are required to be on the site plan.

Ms. Hanlon expects the ZBA would want to see some landscaping around parking. The petitioner should look at adding some shrubs or some other plant materials in addition to the trees on site. Add the dimension of the drive aisle on the site plan.

In the narrative, address the restroom facilities. The ZBA may ask about that and how they are addressing that issue.

McHenry County Department of Health - Jeff Levato

For the proposed building, a general proposed septic area, and a septic replacement area should be added to the site plan.

The Soil Report should be included in the packet.

Portable toilets should be shown on the site plan.

For future use, if there are more than 20 people on site per day, that septic system would be classified as a class 5 injection well, and setbacks to water wells have to be 200 feet to your well and neighboring wells. If it is less than 20 or under people per day, that would be a setback of 75 feet.

If there are going to be more than25 people per day, and the property is served by a water well, it would have to become a non-community public water supply.

Mr. Levato asked if there was plan for restrooms in the immediate future. It was answered that they will have porta potties.

Motion by Ms. Hanlon seconded by Mr. Levato to have the petitioner revise the site plan based on the comments made today, and resubmit to the Committee when complete.

All in favor, motion passes.

V. STATUS UPDATE

It was noted Hempstock Farms was voted down, and Mixed Media has their hearing on November 18th.

VI. MEMBER COMMENTS

There was a discussion regarding Mr. Jose Gaona. He is petitioning for a landscape business with outdoor storage.

Mr. Gaona contacted Ms. Scharlow because he was confused about Mr. Beet's comments. Ms. Scharlow directed him to contact Mr. Beets.

Mr. Beets stated, as of today, there is no formal application to MCDOT.

Mr. Beets stated he is not sure if this is official, but he believes the County is out of the non-dedicated road subdivision program.

VII.ADJOURNMENT

Motion by Ms. Hanlon, seconded by Mr. Levato to adjourned. All members voted aye, motion passed. The meeting adjourned at 10:30 a.m.
