Village of Johnsburg Board of Trustees met April 11.

Here are the minutes provided by the board:

President Hettermann called the meeting to order at 7:00 p.m. in the Village Hall.

AUDIENCE PARTICIPATION – Jenny Willis attended regarding her desire to obtain a building permit to build a fence within a drainage easement on her property in Remington Grove Subdivision. She discussed the annexation and plat approval for the development and maintained that the developer and her attorney believe that the plat governs the development and would overrule the Village’s Zoning Ordinances. She reviewed the public utility and drainage easement language included on plat and opined that they should not be enforced blanketedly as it would have a negative visual impact on the development. Attorney Smoron remarked regarding the zoning ordinance prohibiting fences in drainage easements which was implemented subsequent to the development approval. He explained that the ordinance is deemed to be valid and was implemented to protect the drainage areas.

Ms. Willis stated that ten properties in the subdivision have fences on the property line. It was explained that the ordinance was put into place more recently and some fences were approved prior to the ordinance being put into place. Village Engineer Tim Hartnett explained that the developer engineered the development utilizing rear and side yards to handle storm water and if asked to eliminate them they would likely not agree to it because of potential liability from flooding. Mr. Hartnett clarified that the easements are not “blanket” easements as much engineering went it to the manner in which the development was designed and how stormwater would be handled. He suggested that if she believes the easement is not necessary for proper drainage in the development, Ms. Willis could have the design engineer review it and if agreeable, present their findings to the Village and prepare a vacation of the drainage easement for the Village’s consideration.

Al Robel of 2027 Sunnyside Beach Drive attended to discuss the weight restriction on Fairview Avenue. He remarked that he frequently sees unauthorized trucks traveling on the road. He added that there is still a problem with persons turning left at the bridge. Chief VonAllmen was directed to address the concern.

OMNIBUS AGENDA - Trustee Klemstein moved to approve the Omnibus Agenda. Trustee Foreman seconded the motion. Trustee Frost requested to pull the rejection of bids for Sunnyside Beach Drive. All Trustee voted aye. Motion carried.

 Move to approve the minutes of the March 21, 2023 Regular Meeting of the President and Board of Trustees

 Move to approve Proclamation in support of the Mayor’s Monarch Pledge

 Move to approve a Resolution Proclaiming May 21-27, 2023 as National Safe Boating Week.

 Move to approve a Resolution Proclaiming No Mow May

 Move to reject all bids for the Sunnyside Beach Road Improvement Program

 Move to approve the Village of Johnsburg Façade Improvement Program

SUNNYSIDE BEACH DRIVE - Trustee Frost moved to approve the rejection of all bids for the Sunnyuside Beach Road Improvement project. Trustee Klemstein seconded the motion. Trustee Frost asked for clarification from the engineer on the bids that came in. Mr. Hartnett explained that they were higher than anticipated and he will be meeting with contractors to discuss potential cost savings measures and then come back before the Board with a recommendation. All Trustees voted aye on the roll. Motion carried.

#JOHNSBURG LIFE - Trustee Hagen presented an updated decal supported by his Committee and asked for the Board’s support to proceed with the decal. He stated that the cost is expected to be about one dollar per decal and he is looking to purchase 1000 decals. The board expressed their support for the larger rendering and their conconcurrence in proceeding with the 1000 decals.

CHURCH STREET REALIGNMENT PROJECT – Trustee Foreman moved to accept the bid in the amount of $659,029.00 from Campenella and Sons, Inc for the Church Street Realignment Project. Trustee Letzter seconded the motion. All Trustees voted aye on the roll. Motion carried.

JOHNSBURG LIONS - President Ellen Cravens attended to inform the board that the Johnsburg Lions Board approved moving forward with supporting improvements in Lions Park with an initial contribution of $25,000. Ms. Cravens then presented President Hettermann a check in the amount of $25,000.

ADJOURNMENT – Trustee Foreman moved to adjourn the meeting. Trustee Hagen seconded the motion. All trustees present voted aye. Motion to adjourn was carried at 7:53 p.m.
