Village of Johnsburg President and Board of Trustees met Oct. 12.

Here is the minutes provided by the Board:

President Hettermann called the meeting to order at 7:00 p.m. in the Village Hall.

Attendees Trustee Kevin McEvoy (absent); Trustee Mary Lou Hutchinson; Trustee Tom Curry; Trustee Greg Klemstein; Trustee Kyle Frost (absent); Trustee Josh Hagen; Village Attorney Michael Smoron; Special Project Coordinator Rick Quinn; Village Engineer

AUDIENCE PARTICIPATION – Mr. Geoffrey Brown of 1414 Torrey Trail attended to express concerns about fencing that was recent installed in his neighborhood. He thanked the Village Board for pursuing the purchase of the golf course and stated that he believes it is a great amenity for the community. Mr. Brown provided pictures of his neighbor’s fence constructed of metal mesh stretched across 4x4 posts. He asked the Village Board if the type of fencing utilized by his neighbor is allowed in a residential district. Ms. Peters stated that the matter came to her attention the previous day and she reviewed the zoning ordinance, which does not appear to prevent the fencing however, she has asked the building department to look into the building codes regarding the matter.

OMNIBUS AGENDA Trustee Curry moved to approve the Omnibus Agenda. Trustee Hutchinson seconded the motion. Trustee Hutchinson requested the removal of Ordinance 17- 18-12 for a separate vote. All trustees present voted aye on the roll. Motion carried.

• Move to approve the minutes of the September 19, 2017 regular meeting of the President and Board of Trustees

• Move to approve Ordinance 17-18-12 Granting a variance to Section 7.2-1 Permitted Fences of the Johnsburg Zoning Ordinance to permit a fence in the front yard for the property commonly known as 1524 River Terrace Drive, Johnsburg, Illinois

• Move to approve Ordinance 17-18-15 granting a variance to Section 7.1-5 Accessory Buildings and Structures of the Johnsburg Zoning Ordinance for the Property Commonly Known as 2215 Fairview Avenue, Johnsburg, Illinois

• Move to approve Ordinance 17-18-17 Approving the Jurisdictional Transfer of Old Bay Road to the Village of Johnsburg from the Village of Lakemoor.

• Move to approve payment in the amount of $467,656.17 for the Church Street Road Improvement Project.

ORDINANCE 17-18-12 FENCE VARIANCE - Trustee Curry moved to approve Ordinance 17-18-12 Granting a Variance to Section 7.2-1 Permitted Fences of the Johnsburg Zoning Ordinance to permit a fence in the front yard for the property commonly known as 1524 River Terrace Drive, Johnsburg, Illinois. Trustee Hagen seconded the motion. Trustee Hutchinson stated that she wanted to remove the ordinance from the Omnibus Agenda to take separate action on the matter. She iterated her concerns about approving a fence in the front yard on waterfront property, which is completely closed and is not consistent with fencing approved on water front properties in the past. She thanked the residents for working together to come to an amicable resolution. Trustee Klemstein, Hagen, Curry and President Hettermann voted aye. Trustee Hutchinson voted no. Motion carried.

PRESIDENT’S REPORT – President Hettermann requested a report from Trustee Curry regarding the Holiday Magic event. Trustee Curry explained that the event is set for Friday, December 1, 2017 and that all of the regular plans will proceed but the committee has been discussing the inclusion of a parade bringing Santa to the event. He explained that one thought is to utilize Johnsburg Road for the parade for which he has safety concerns related to closing down Johnsburg Road during the late afternoon/evening rush and the fact that it will be dark at that time. Another thought is to utilize the Jr. High School parking lot for the parade line up and direct the parade down Church Street to the Community Club. President Hettermann explained that he supported the idea of a parade as originally presented, which was to hold the parade on a Saturday afternoon. He stated that he shares Trustee Curry’s concerns about having the parade on a Friday. Mr. Hartnett explained that the majority of the construction will be completed within the next couple of weeks. The only outstanding item will be the pedestrian lights expected for installation in November. He explained that the lights illuminate the sidewalk area and would not adequately cast light for the parade. Trustee Curry agreed that holding the parade on Saturday in the afternoon would be best. The board concurred that foregoing the parade this year and planning for it next year when it could be scheduled for a Saturday may be best. Trustee Hagen questioned if planning the event on a Sunday is an alternative. Trustee Curry stated that he would look into that alternative.

ICE MILLER ENGAGEMENT LETTER -Trustee Hutchinson moved to approve the engagement letter from Ice Miller for bond counsel services related to financing of the golf course acquisition. Trustee Klemstein seconded the motion. All trustees present voted aye on the roll. Motion carried.

GOLF COURSE FINANCING – Trustee Hutchinson move to approve Ordinance 17-18-16 An Ordinance authorizing and providing for an Installment Purchase Agreement for the purpose of financing the costs of certain capital related projects in and for the Village of Johnsburg, McHenry County, Illinois, and authorizing and providing for the issue of General Obligation Debt Certificates, Series 2017, of said Village evidencing the rights to payment under such Agreement, prescribing the details of the Agreement and Certificates, and providing security for and means of payment under the Agreement of the Certificates. Trustee Klemstein seconded the motion. Ms. Peters summarized the terms of the financing. Attorney Smoron discussed what actions could affect the tax-exempt status of the financing. He stated that bond counsel is familiar with the tax-exempt requirements and it will take some work to achieve the proper structure of the management agreement but it has been done in the past. All Trustees present voted aye on the roll. Motion carried

ADJOURNMENT – Trustee Hutchinson moved to adjourn the meeting. Trustee Klemstein seconded the motion. All Trustees voted aye. Motion carried at 7:27 p.m.
