Call To Order:
A meeting of the Huntley Liquor Commission was called to order on Thursday, May 24, 2018 at 7:00 p.m. in the Municipal Complex, Village Board Room, 10987 Main Street, Huntley, Illinois 60142.
Attendance:
Present: Chairman Charles H. Sass; Commissioners: Ronda Goldman, Timothy Hoeft, Niko Kanakaris, Harry Leopold, John Piwko and JR Westberg.
Absent: None
In Attendance: Village Manager David Johnson, Assistant Village Manager Lisa Armour, Management Assistant Barbara Read, Director of Public Works and Engineering Timothy Farrell, Chief Robert Porter, Director of Finance Cathy Haley and Village Attorney John Cowlin.

A. Consideration of an Ordinance Amending the Huntley Code of Ordinances – Business Regulations, Alcoholic Beverages Chapter 110l Section 110.24 − Limitation on Licenses − Adding one Class “A” License – Liquor Control Ordinance
Chairman Sass reported that per the terms of the Redevelopment Agreement with BBQ King Huntley, LLC, approved via Ordinance (O) 2017-08.38, the Village agreed to create a liquor license for BBQ King Smokehouse Huntley Inc. (BBQ King) subject to meeting all requirements for the approval of a license. The Village regulates the sale of alcoholic beverages in the Village through its Liquor Control Ordinance which provides for the issuance of certain classes of liquor licenses and establishes the number of licenses available in each class.
Staff Analysis-
Consideration is being requested to amend the Liquor Control Ordinance to make available fifteen (15) Class “A” licenses instead of fourteen (14) in order to provide for the application from BBQ King, 11706 Coral Street. The application has been reviewed and Staff will continue to work with the petitioner to finalize all necessary documents required. It is not uncommon for all documents to not be submitted with the application while the project is under construction. The liquor license will not become effective until all documents are submitted and finalized.
The Class “A” license shall permit the retail, sale on the premises specified, of alcoholic liquor, for consumption on the premises, as well as other retail sale of alcoholic liquor in the original package. Listed below are the current licensed establishments with a Class “A” license:

Financial Impact-
The fee received for a yearly Class “A” License is $1,500.00.
Legal Analysis-
Section 110.24 of the Village Code of Ordinances limits the number of available licenses in each class. There is no available Class “A” license; therefore, to issue a license to BBQ King Smokehouse Huntley Inc. the Commission must create one (1) additional Class “A” license.

B. Consideration of an Ordinance Approving the Issuance of a Class “A” Liquor License to BBQ King Smokehouse Huntley Inc.; 11706 Coral Street
Chairman Sass reported that per the terms of the Redevelopment Agreement with BBQ King Huntley, LLC, approved via Ordinance (O) 2017-08.38, the Village agreed to create a liquor license for the BBQ King Smokehouse Huntley Inc. (BBQ King) subject to meeting all requirements for the approval of a license. The Village of Huntley regulates the sale of alcoholic beverages in the Village through its Liquor Control Ordinance, which provides for the issuance of certain classes of liquor licenses and establishes the number of licenses available in each class.
Staff Analysis-
The Village is in receipt of an application for a Class “A” liquor license from BBQ King to operate a restaurant with video gaming at 11706 Coral Street. The multi-tenant commercial building consists of approximately 12,161 square feet. The restaurant portion will be approximately 7,863 square feet. Outside seating is planned in the front of the restaurant on private property. No outside events are planned at this time. As part of the application process the following items are required to be submitted:

All required documents have not yet been submitted which is not uncommon for a restaurant still under construction. Staff will continue to work with the petitioner to complete all necessary paperwork. The Liquor Commission may approve the Class “A” liquor license with the condition of approval being that BBQ King provide the documents before the Village’s liquor license becomes effective.
Financial Impact-
The yearly fee of $1,500 for the liquor license has been received and deposited to 01-00-1-4120 / Liquor License revenue line item.
Legal Analysis-
Section 110 of the Village Code of Ordinances regulates liquor sales in the Village. The application has been reviewed and is in compliance with Section 110: Alcoholic Beverages requirements.

A Motion was made to approve an Ordinance for the Approval and Issuance of a Class “A” Liquor License to BBQ King Smokehouse Huntley Inc., 11706 Coral Street subject to the following conditions of approval:
1. Petitioner must submit all required paperwork as outlined in the application.
2. Petitioner must show proof of the State of Illinois Liquor Licenses before the Village of Huntley Class “A” Liquor License becomes effective.
