Village of Johnsburg Village Board met Dec. 10.

Here is the minutes provided by the board:

AUDIENCE PARTICPATION

Bob Hogan of 2308 W. Johnsburg Road attended to request consideration for a cannabis dispensary on his property. It was explained that there is an ordinance on the agenda proposing the placement of Cannabis Dispensaries in the B-3 and C-1 zoning districts and should the ordinance be approved, Mr. Hogan would have to request zoning consideration in order to pursue a dispensary on his property.

Sam and Carrie Posey of 3511 W. Johnsburg Road attended the meeting to express concerns with their ability to sell their home in the future due to the proposed B-2 zoning of the property adjacent to their home. They inquired if they could also pursue business zoning for their property and still reside there. President Hettermann suggested that they talk further with Village Administrator Claudett Sofiakis regarding their options and the zoning process.

Mr. and Mrs. Posey also expressed concerns with school buses being passed on Johnsburg Road when picking up and dropping off children. They requested increased enforcement and bus cameras. President Hettermann stated that they would need to speak to the school district about the bus cameras and follow up with Chief VonAllmen regarding enforcement.

OMNIBUS AGENDA – Trustee Foreman moved to approve the Omnibus Agenda. Trustee Frost seconded the motion. Trustee Frost requested the removal of Ordinance 19-20-41. All Trustees present voted aye on the roll. Motion carried.

ORDINANCE 19-20-41 - Trustee Frost moved to approve Ordinance 19-20-41 Amending the Johnsburg Municipal Code adding Chapter 45 Imposing a Cannabis Retail Occupation Tax. Trustee Klemstein seconded the motion. Trustee Frost questioned what other communities are charging. Ms. Sofiakis explained that 3% is the maximum that can be imposed and most communities are charging 3%. All Trustees present voted aye on the roll. Motion carried.

PRESIDENT’S REPORT – President Hettermann presented Krzysztof Lenart with a Certificate of Recognition for his generous donation of park land in Whispering Ridge Estates. In recognition of the donation, the park was officially dedicated as Lenart Park.

President Hettermann recognized the generous contributions made by the Johnsburg Lions Club who received record donations this year for the Shop with a Cop program. He also acknowledge Raymond’s Bowl, the Johnsburg Lions Club and the other generous contributors towards the Jeeps on the Run event which raised $92,000 in toys and donations for the Toys for Tots program, of which McHenry County received $10,000 from the event. President Hettermann remarked about the generosity of the Johnsburg Community. He questioned if there were any issues regarding the Jeeps on the Run event. Trustee Frost remarked about damage to the open field used for parking. President Hettermann explained that there was some rutting of the field due to weather conditions which is the case with any event taking place during inclement weather. He added that there was an individual doing donuts in the field who was not part of the event and Jeeps on the Run attendees turned in information regarding the individual.

Trustee Curry stated that he had concerns regarding dirt tracking into the parking lot and beer cans and shoes left in the field. He added that his daughter was working at Angelo’s during the event and she observed a decrease in shoppers during the event. He questioned if the event brings business to town or drives people away. President Hettermann replied that the event does bring business to the community as people were lining up to get gas and stuck around to dine at area restaurants following the event. Trustee Curry agreed that it is a great event and everything will be fine with some additional cleanup effort following the event.

Ordinance 19-20-43 Tax Levy – Trustee Klemstein explained that the Finance Committee recommended the Board pursue a levy, which includes an increase for new growth and a CPI adjustment. They further recommended that the board direct the additional funds towards Police Pension. President Hettermann pointed out that the board has kept taxes flat the last several years, only pursuing new growth and suggested that this year adding the CPI adjustment is appropriate to keep up with inflationary costs. Trustee Klemstein moved to approve Ordinance 19-20-43 Levying Taxes for General and Corporate pursues for the 2019 Tax Year. Trustee Foreman seconded the motion. Trustee Klemstein discussed the levy options and their impact to individual homeowners. Trustee Foreman expressed that the Village has been fiscally responsible and she supports the levy as proposed. All Trustees present voted aye on the roll. Motion carried.

BUSH SCHOOL REDEVELOPMENT AGREEMENT – Village Administrator Claudett Sofiakis reported on status of the proposed Development Agreement. She explained that a conference call was held with General Capital and updates are being made to the agreement and the exhibits to proceed before the board in the new year.

COMMITTEE REPORTS – Trustee Foreman reported on a very successful Holiday Magic event. She stated that A&B Roofing took first place and the Remax Agency out of Fox Lake took second place in the parade entries. Trustee Foreman thanked Halftime for their generous donation of pizzas for the event.

Trustee Foreman informed the Board that the School’s athletic director attended the last meeting requesting permission to install a 200 foot home run fence on the Mustang Field for high school play.

She explained that they propose to install the fence, a scoreboard and possibly press boxes but would like to get the fence installed before Spring. President Hettermann questioned if the fence installation would interfere with other leagues using the field. Trustee Curry stated that it would not impact Johnsburg Pigtail League but it would impact the older JBBL teams so the School has offered to let them play on the school’s fields. President Hettermann expressed that the Village needs to make sure that all organizations have the opportunity to use the fields. He stated that a representative from JBBL and other leagues should be at the meeting when the matter is discussed further with the School. Trustee Curry stated that the athletic director has also offered to replace the scoreboard on the Showcase Field with assistance from JBBL and the Junior Skyhawks will arrange to have the contractor install their scoreboard at the same time.

Trustee Foreman reported that the Committee wishes to install a pier on the fishing pond in Lake Dawnwood and is pursuing bids for the improvement. President Hettermann directed to make certain to pursue a more permanent structure that will be safe with minimal maintenance. He asked that specs be developed to obtain a proper bid to include in the budget.

Trustee Curry reported that the Development and Governmental Affairs Committee met to discuss the proposed B2 zoning change and is reviewing the ordinance binders.

Trustee Frost reported that the Ordinance Committee recommended approval of the ordinance regulating cannabis use and they will continue their review of outstanding items.

Trustee Klemstein reported that the Finance Committee met the previous night regarding the Tax Levy and cannabis retail occupation tax.

ADJOURNMENT – Trustee Frost moved to adjourn the meeting. Trustee Hagen seconded the motion. All Trustees present voted aye on the roll. Motion carried at 8:02 p.m.
