McHenry County Staff Plat Review Board Met May 5.

A. Michael and Sia Weyrauch – Petition #2019-019 – Conditional Use Permit to allow for a Landscape Business with Outdoor Storage
Present on behalf of the petition was Mr. Michael Weyrauch.
WATER RESOURCES- Joanna Colletti
Ms. Colletti noted in general, the site plan is fine from a stormwater perspective. If revisions to the site plan are necessary based on other comments, a re-review by the Water Resources Division will be required. Once the permit is ready to applied for, there are items that will need to be addressed. She mentioned there was a mulch pile that was removed. If it returns, the area will be considered impervious and will need to be accounted for.
The berm that was placed adjacent to Cary Algonquin Road will need to be modified. Ms. Colletti told the petitioner to work with their engineer to modify the plans as necessary.
MCDOT - Ray Beets
Mr. Beets noted the petitioner made a request for 3 variances from the McHenry County Access Control and Right-of-Way Management Ordinance. One is to waive the fee charged for an access permit change from minor access-residential to a minor access-other. A reduction in the setback requirement for on-site stormwater detention, and waiver of the required right-of-way dedication to the County resulting from change in use of the property.
The Transportation Committee voted in favor of granting the variance request for waiver of right-of way dedication. The other two variance requests were not granted.
The petitioner will have to pay the fee of $1,500 for the highway access application.
Mr. Beets also informed the petitioner, that the existing stone retaining wall should be labeled as existing stone barn foundation wall. This is a left over component from the old barn structure.
It was noted there is a potential discharge path that appears to be close to the existing well. This could potentially create well contamination from vehicle and roadway pollutants.
The landscaping appears to go through the detention basin. The landscaping would not survive and could potentially catch debris from flows through the box culvert.
The label for the existing box cattle crossing should be labeled as existing 6' X 6' box culvert.
The red contour lines appear to be incomplete and it looks like the basin is encroaching into the right of way and setback. Mr. Varga stated the basin cannot be in this location and must be redesigned to be offset from the right-of-way to meet the setback requirements. In looking at the overflow, it is higher than the box culvert. The emergency flow would need to be lowered.
The berm toward the south adjacent to the County Highway requires a minimum setback of 10 feet all along the berm from the right-of-way to the toe of the berm. It is not clear if this setback requirement is being met.
Mr. Beets noted the County Ordinance does not allow a berm within 10 feet from right-of-way. The berm needs to meet the minimum 10-foot setback.
BUILDING COMMENTS - Adam Wallen
Mr. Wallen stated his only comment is regarding the change of use to the existing barn. A permit will be required because the barn will be used for commercial use.
PLANNING AND ZONING COMMENTS - Renee Hanlon
Ms. Hanlon stated there will be no de-icing agents to be stored.
The petitioner is asking for a variation to have storage located in the effective street yard and to allow screening to be installed at 4 feet in height instead of 6 feet.
There will be no sales from the site.
There is no signage on the site plan. If signs are planned, a permit will be required.
HEALTH - Charlie Oliver
Mr. Oliver asked about restrooms, and if they will be required.
Mr. Wallen stated as long as there are no employees, no retail operations, and it is operating as a cold storage building, under the Illinois State Plumbing Code, it is not a place of employment or public access, so employee or public restrooms are not required.
The setback distance from the berm to the well needs to be verified.
Motion by Mr. Beets, seconded by Mr. Wallen to have the petitioner revise and resubmit the site plan and to the Staff Plat Committee for review.
All members voted aye, motion passed.
V. STATUS UPDATE
Ms. Hanlon mentioned the potential campgrounds in Spring Grove will not be happening. The petition has been withdrawn.
VI. MEMBER COMMENTS
Mr. Beets asked about the Pleasant Grove Solar Farm. Ms. Hanlon stated they have acquired the rights for the property.

Motion by Mr. Oliver, seconded by Ms. Hanlon to adjourn. All members voted aye, motion carried. The meeting adjourned at 9:53 a.m.
