Village of Johnsburg President and Board of Trustees met Nov. 15.

PRESIDENT’S REPORT - President Hettermann reminded all that the holiday party is on December 2nd and Holiday Magic is on December 10th. Trustee Foremann reviewed plans for the Holiday Magic parade route and discussed details related to the festivities following the parade.

OLD BUSINESS

ORDINANCE 22-23-11 – The Board discussed Ordinance 22-23-11 Attorney Smoron discussed the importance of including specific language in the ordinance so the requirements can be reasonably understood. Trustee Frost discussed changes made in the draft presented to the Board at the meeting. He explained that the previous drafts incorporated operable vehicles into regulations related to parking of recreational vehicles which created confusion regarding side and rear yard parking restrictions. He explained that the current draft removes the language regulating the parking of operable vehicles from the changes proposed to Chapter 12.06A but still regulates operable vehicles in Chapter 15. Trustee Hagen questioned the need to regulate parking in th front yards. He offered that if residents want to have a party every weekend and cars are parked in the front yard, the Village should not interfere. Trustee Frost explained the concerns raised at the Ordinance Committee regarding instances in which residents park in their front yard regularly, tearing up the ditchline and impeding vegetative growth in the yard.

Trustee Hagen expressed concern that the proposed language is more restrictive than necessary. Chief VonAllmen explained that there are already laws that prevent overnight parking on the road, in front of mailboxes and driveways, or otherwise infringing upon the roadway, causing hazardous conditions, but the Village does not have clear language regulating parking in front yards. He added that it has been an ongoing concern and the matter has been discussed by the Ordinance Committee many times over the past few years. Trustee Letzter concurred that it will address those extreme circumstances that are problems. Trustee Hagen expressed concern about placing the burden on residents to have to call in when they plan to have vehicles parked in their front yard and questioned if the enforcement can be driven by a complaint being made. Attorney Smoron stated that the Village needs clear and objective regulations to address the extreme circumstances and that he believes the proposed language provides that and is reasonable. Trustee Klemstein moved to approve Ordinance 22-23-11 as reflected in the third draft presented at the meeting. Trustee Curry seconded the motion. The Board discussed sections of the ordinance addressing the parking of recreational vehicles. Concern was raised that the language “types or like kind” is confusing and unnecessary. Trustee Klemstein moved to amend his original motion to remove “types or like kind” from the ordinance. Trustee Curry seconded the amended motion. Trustee Hagen reiterated his concerns regarding the language being too restrictive. Chief VonAllmen pointed out that the ordinance addresses very specific circumstances that need to occur in order for the activity to be considered a violation. He added that in most cases a party or special event will rarely result in vehicles remaining in the front yard overnight. Trustess Foreman, Curry, Frost, Klemstein and Letzter voted aye on the amended ordinance. Trustee Hagen voted no. Motion carried. Trustees Foreman, Curry, Frost, Klemstein and Letzter voted aye on the original motion. Trustee Hagen voted no. Motion carried.

ADJOURNMENT – Trustee Frost moved to adjourn the meeting. Trustee Foreman seconded the motion. All Trustees voted aye. Motion to adjourn was carried at 7:55 p.m.
