Harvard City Council approved the revocation of a conditional use agreement at its Dec. 15 meeting.
This conditional use agreement was included in an annexation agreement that was made by the city in 2009. The agreement was related to mining operations and batch plant operation, in addition to an amendment that was made in 2011 with Thomas Merryman.
The city’s Planning and Zoning Commission recommended the passage of the revocation petition following evidence and testimony presented at its Dec. 1 meeting.
In deliberation, council members noted that there was no requirement to contact state authorities in order to facilitate reclamation of the area. Council members also discussed that any sale of the property would require a new operator to seek conditional use from the city.
At the time of the meeting, the site consisted of mounds of sand and pea stone and was considered to be of little value by those present at the meeting. Following the reclamation, the meeting notes state that the area would be zoned as two lots -- one B3 and one R1 lot -- and further development on the latter would require a subdivision process to facilitate a public hearing.
The council voted to approve the measure unanimously.
