Here is the agenda provided by the Commission:

5. Open Hearing – DPC Properties (petitioner)

The petitioner is requesting a variation from Section 17.36.020, Location of Accessory Uses, for a reduction in the side and rear yard setbacks for the proposed Culvers Restaurant accessory use.

The petitioner is further requesting a variation from Section 17.20.080, Lot Area, Yard and Bulk Regulations, to increase the height of an accessory use.

Subject property is located at 5410 S. US Highway 14

6. Open Hearing – Thomas Merryman and Consolidated Materials Inc. (petitioners)

The petitioners are seeking to reclassify subject property as M-1 zoning for a period of ten (10) years; to obtain a conditional use for a mining operation for ten (10) years including extracting gravel, sand and other raw materials; recycling of concrete and asphalt materials and upon the expiration of the M-1 zoning, to reclassify the northeasterly 47 acres of the subject property as B-

3 Commercial District with the remaining 61 acres of the property reclassified as R-1 Single Family Residence District.

The subject property is located approximately 1,550 feet east of the intersection of McGuire Road and Route 14 on the south side of McGuire Road and immediately adjoining and west of the entrance to Rush Creek McHenry County Conservation District area.
