McHenry County Staff Plat Review Committee met Sept. 19.

Here is the minutes provided by the committee:

I. CALL TO ORDER

The meeting was called to order by Mr. Sandquist at 8:34 AM. Meeting called to order at: 8:34 AM by Dennis Sandquist.

PRESENT: Nomm, Colletti, Wallen, Sandquist, Magee ABSENT: Boeckmann, Beets, Levato, Martin

IV. SITE PLAN REVIEW

A. David & Linda Moore- Petition #18-039- Conditional Use Permit to allow for a Bed and Breakfast

Homeowner's David and Linda Moore were present.

STORMWATER COMMENTS - Joanna Colletti

Ms. Colletti noted there were no comments with respect to the Stormwater Management Ordinance based on the plans that were submitted.

PLANNING and ZONING - Kim Kolner

Ms. Kolner provided comments that included definitions from the Unified Development Ordinance for Bed and Breakfast, Vacation Rental and Boarding house. She noted that Bed and Breakfast has a limit of 5 guest rooms. She included lighting requirements and mentioned that signage is not included and needs to comply with Article 18. She informed the petitioners if they would like to alter the request to include vacation rental it must be done in writing and could be done after this meeting.

BUILDING - Adam Wallen

Mr. Wallen reviewed his comments with regard to the building codes due to the new use in the residence. He mentioned that Item #2, in the case where units with 5 or fewer guest rooms and are owner occupied will be reviewed under the residential code. He noted that if it exceeds that number and the owner does not live in the residence the code becomes more intense. The change of use will require a permit and will also require a review by the fire department. He mentioned that in conversation with the fire district they would require a sprinkler system.

DEPARTMENT OF HEALTH - Patti Nomm

Ms. Nomm asked if the use of the facility would be limited to bed and breakfast guest only. The owners informed the committee that it was breakfast only. They also noted that there were no additional employees in addition to the residents of the home and that the outbuilding/garage is not included. Ms. Nomm mentioned that with the change in use, the recently installed onsite wastewater treatment system would be categorized as a class V injection well and would now require a minimum setback of 200' from the septic field to any neighboring water wells. Additionally, she would recommend that a water sample is collected annually and a 100% future septic system replacement area for the onsite waste water treatment system should be demonstrated on the site plan as conditions of the approval of the conditional use.

MCDOT - Ray Beets

Mr. Beets was not present at the meeting, but provided his comments in writing. An access permit will be required from MCDOT and a plat of dedication and recording of such project increasing the right of way dedication from 35 feet to the required 85 feet as required by the McHenry County Access Control and Right-of-Way Management Ordinance.

Ms. Moore asked how long would the conditional use be valid. Mr. Kolner stated that 10 years was the standard, but could requested for a longer period of time.

Motion by Ms. Nomm, seconded by Ms. Kolner to accept the site plan with the additional well statement. All members present voting aye. Motion carried.

B. SolarStoneIllinois,LLC/Aavang-Petition#18-038-ConditionalUsePermitfora Solar Farm

STORMWATER COMMENTS - Joanna Colletti

Ms. Coletti provided her comments in writing mentioned that her comments are related to the Stormwater Ordinance.

She indicated that a drain tile survey would be required as part of the permitting process. Impervious area with respect to runoff will need to be calculated to determine the need for detention. She informed that grass paved areas or pervious pavers can be used on driveways. Wetland area 1 & 2 and buffers should be added to the site plan. A wetland determination report will be required and if any development is proposed within a wetland or buffer area additional permit requirements will need to be met. Additional items will be required for the permit process.

MCDOT - Ray Beets

Mr. Beets was not present at the meeting, but provided his comments in writing. He commented that the site plan shows Greenwood Road labeled as County Road 120. This should be corrected to Illinois Route 120. Removal of the previous gravel access out to Fleming Road is required to gain access from another street. The site plan should be revised to show the footprint of the existing field access and culvert and a note that the existing field access and culvert off Fleming Road shall be removed with disturbed areas of right-of-way restored with topsoil and seed blanket.

PLANNING and ZONING - Kim Kolner

Ms. Kolner provided her comments in writing. She noted that the petition was filed prior to the adoption of the solar farm use standards and the majority of the amendments will be seen as conditions. The property is located in a sensitive aquifer recharge area, but not in a class III groundwater overlay district. She informed that no lighting is proposed, but if it will be used it must comply with the UDO.

BUILDING - Adam Wallen

Mr. Wallen provided his comments in writing. His comments were geared toward access and fire department access. He requested the dimensions on the turnaround and to also submit this information to the Woodstock Fire District.

DEPARTMENT OF HEALTH - Patti Nomm

No comment.

The items that will be resubmitted can be submitted electronically.

Motion by Ms. Kolner, seconded by Ms. Colletti to accept the site plan upon receipt of the revisions. All members present voting aye. Motion carried.

Revisions should be submitted at least one week prior to the hearing on October 4th.

C. Re-Submittal - OneEnergy Dahm Trust - Conditional Use Permit to Allow for a Solar Farm - 18-031

Representing Dahm/OneEnergy Development LLC:

Eric Udelhofen, One Energy Development

Mr. Sandquist informed the Committee that the voting meeting for this petition is today. The ZBA requested removal of the inverter pad and turnaround. They also extended the land buffer along Charles Road and landscaping proposed along Raffle Road.

Mr. Udenhofen spoke regarding the changes to the access points. He noted they added the wetland determination area from NRCS on the northwest corner. All facilities are outside of the 100 foot setback.

MCDOT is requiring a 70' right-of-way that can be added to the plan at this meeting.

Motion by Ms. Nomm, seconded by Ms. Colletti to approve the site plan with the revision made today. All member present voting aye. Motion carried.

Motion by Mr. Wallen, seconded by Ms. Nomm to adjourn the meeting. All members present voting aye. Motion carried.
