Reports suggest that McHenry County Board Chairman Jack Franks ignored the law when it came to the replacement of a countywide elected official.
According to the McHenry County Blog, the law states: "When a vacancy occurs in any elective county office…the county board…shall declare that such vacancy exists and notification thereof shall be given to the county central committee or the appropriate county board or board of county commissioners district committee of each established political party within three days of the occurrence of the vacancy."
Jack Franks allegedly broke the law regarding this ordinance when he filled the position when Pam Palmer stepped down as the county auditor in January of 2018.
Officials also claim that he fails to adhere to the law that a vacancy should be filled within the first 60 days that the position is available.
The law states that "The vacancy shall be filled within 60 days by the appointment of the chair of the county board…with the advice and consent of the county board."
