City of Greenwood Village City Council met April 4.

1. CALL TO ORDER
The City Council and Local Liquor Licensing Authority of the City of Greenwood Village met in a regular session in the Council Chambers at Greenwood Village City Hall, 6060 South Quebec Street, Greenwood Village, County of Arapahoe, State of Colorado, at 6:47 p.m., following a Study Session in which Council discussed the temporary Cherry Creek Village South Neighborhood proposed Traffic Calming measures and proposed updates to the Greenwood Village Construction Site Manual.

A motion was made by Councilmember Hilton, seconded by Councilmember Ingebretsen; to approve the March 7, 2022 minutes, as submitted. The motion carried by unanimous polled vote.

5. PRESENTATION/PROCLAMATION
A. Arbor Day Proclamation: Tree City USA Presentation (Dana Coelho, State Forester and Daniel Kissinger, Open Space and Urban Forestry Supervisor)
In lieu of reading the proclamation, Mayor Lantz entered the proclamation into the record.
Parks Manager Dustin Huff and Parks Supervisor Daniel Kissinger were presented the Tree City USA for 2021 by Ms. Dana Coelho, Urban and Community Forestry Program Manager for the Colorado State Forest Service.

Parks, Trails, and Recreation Director Suzanne Moore invited everyone to Westlands Park Arbor Day Celebration with Greenwood Elementary Environmental Club on April 15, 2022.

7. CONSENT
Mayor Lantz noted the titles would not be read aloud and would be enacted by one motion and vote unless a Councilmember requested that an item be removed from the Consent Agenda and considered separately.
A motion was made by Councilmember Ingebretsen, seconded by Councilmember Barnacle; to adopt the Consent Agenda, as submitted. She waived reading in full of the Ordinance on Second Reading and moved to publish by title only on the Village’s website. The motion carried by unanimous polled vote.

9. ORDINANCES AND RESOLUTIONS
A. Ordinance No. 04-22: First Reading: An Ordinance Adopting a First Amended Budget and Providing for the Supplemental Appropriation of Money for the Various Funds, Departments, Offices and Agencies of the City of Greenwood Village, Colorado, for the 2022 Fiscal Year (INGEBRETSEN)
Finance Director Shawn Cordsen noted this amendment addressed the carry overs from 2021, mostly due to the supply chain shortages in the previous year, to move projects forward.
Councilmember Ingebretsen inquired about the funds allocated to the Police Department for investigation equipment.
Chief Dustin Varney clarified the investigation equipment the Police Department uses regularly for traffic accident investigations was unrepairable and no longer available. He noted the funds would be used to purchase new equipment with updated technology.
Councilmember Johnston noted her support of the Arts and providing scholarships, however, she questioned the $5,000 appropriated to the Arts and Humanities Council for a third scholarship, and whether those funds should be applied towards other projects in the Village.
Parks, Trails, and Recreation Director Moore responded the Arts and Humanities Council acquired the $5,000 through fundraising activities and this was not city funds paid by taxpayers. She noted the funds have been in the budget and applications have been received regarding the program.
There was brief discussion on whether only two scholarships should be awarded in the future and why it was open to students in Arapahoe County and not just Greenwood Village residents.
A motion was made by Councilmember Ingebretsen, seconded by Councilmember Barnacle; to approve Ordinance No. 04-22: First Reading: An Ordinance Adopting a First Amended Budget and Providing for the Supplemental Appropriation of Money for the Various Funds, Departments, Offices and Agencies of the City of Greenwood Village, Colorado, for the 2022 Fiscal Year. She waived reading in full and moved to publish in full on the Village’s website. The motion carried by unanimous polled vote.

8. PUBLIC HEARING
A. Resolution No. 12-22: A Resolution to Grant a Beer & Wine Liquor License to GDLP Restaurants, LLC d/b/a Wingstop, 8547 E. Arapahoe Road Unit D, Greenwood Village, CO 80112 (BARNACLE)
A quasi-judicial public hearing was held at 7:06 p.m. by City Council, acting as the Local Liquor Licensing Authority, to determine whether or not the application for a Beer & Wine Liquor License to GDLP Restaurants, LLC d/b/a Wingstop, 8547 W. Arapahoe Road Unit D, Greenwood Village, CO 80112 should be granted or denied.
Mayor Lantz accepted into evidence Exhibit A which was a copy of the City Clerk's Office preliminary report and findings and the original application and related papers. The petition was accepted into evidence as Exhibit B.
City Attorney Tonya Haas Davidson stated the application was in proper form and order; the necessary fees had been paid, and submitted into evidence Exhibits C and D which were the Certificate of Public Notice and the Certificate of Posting.
Mayor Lantz accepted Exhibits C and D into evidence and made them a part of the hearing record.
A motion was made by Councilmember Ingebretsen, seconded by Councilmember Johnston; to accept the application and exhibits in lieu of testimony. The motion carried by unanimous voice vote.
The applicant, Mr. Jason Hurtado, 3988 Miners Candle Drive, Castle Rock, provided a brief review of the liquor training policy, ID verification, and noted there were 11 locations throughout Colorado which have not had any liquor violations to date. He stated the business has been open since February 2022.
City Attorney Haas-Davidson left the meeting at 7:10 p.m.
A motion was made by Councilmember Barnacle, seconded by Councilmember Ingebretsen; to close the public hearing. The motion carried by unanimous voice vote.
A motion was made by Councilmember Barnacle, seconded by Councilmember Wiesner; to adopt Resolution No. 12-22: A Resolution to Grant a Beer & Wine Liquor License to GDLP Restaurants, LLC d/b/a Wingstop, 8547 E. Arapahoe Road Unit D, Greenwood Village, CO 80112.
Councilmember Johnston inquired about requirements for the “needs and desires” petition which was circulated for signatures of residents and businesses within a one-mile radius of the proposed liquor license.
City Clerk Susan Ortiz gave a brief explanation of the Liquor Rules and Regulations to prove the “needs and desires” of the neighborhood, noting the different ways this may be accomplished by the applicant.
Mayor Lantz welcomed the new licensee and cautioned them about the importance of proper training and serving practices of alcohol.

Parks, Trails, and Recreation Director Moore responded to the earlier question about the number of trees in the Village, noting there were 12,000 trees, 1,300 of those trees were along the High Line Canal.
