I. Call to Order

The meeting was called to order at 6:00 p.m. by Mayor Kownick.

II. Roll Call

The roll was called and all were present.

III. Pledge of Allegiance

Mayor Kownick led in the recitation of the Pledge of Allegiance.

IV. Open Forum

Martha Ritter, 239 N. School Street, stated the pedestrian crossing near the fire station is dangerous because vehicles are not yielding when the yellow lights are flashing.

There being no further comments, Open Forum was closed at 6:02 p.m.

V. Mayor's Report

Mayor Kownick stated the official groundbreaking for the McHenry County Regional Training Center Firing Range took place on April 27, 2023.

Mayor Kownick stated he testified at the Illinois House Cities and Villages Committee as Chairman of the Metropolitan Mayors Caucus regarding the State's Local Government Distributive Fund (LGDF).

A. Recognition of Trustee Kimberly Covelli for Service as Village Trustee

Mayor Kownick recognized Trustee Covelli for her 8 years of service to the Village of Cary.

B. Swearing in of Village Trustee Dale Collier, Jr.

Mayor Kownick swore in Village Trustee Dale Collier, Jr.

C. Swearing in of Village Trustee Ellen McAlpine

Mayor Kownick swore in Village Trustee Ellen McAlpine.

E. Proclamation National Bike Month

Mayor Kownick proclaimed May as National Bike Month.

G. Proposed Central Cary Tax Increment Financing District (TIF District #3) Plan Availability

Mayor Kownick stated the Village of Cary is currently analyzing the potential designation of a redevelopment project area and redevelopment plan for the proposed Central Cary Tax Increment Financing District (TIF District #3). Pursuant to Illinois State Statute 65 ILCS 5/11-74.4-5 (a), prior to the adoption of an ordinance proposing the designation of a redevelopment project area, or approving a redevelopment plan or project, the municipality shall adopt an ordinance fixing a time and place for public hearing. At least 10 days prior to the adoption of an ordinance establishing a time and place for the public hearing, the Village is required to make available for public inspection a redevelopment plan or a separate report that provides in reasonable detail the basis for the eligibility of the redevelopment project area.

Pursuant to this statute, the Village of Cary is announcing the availability of the Eligibility Report, Redevelopment Project and Plan, and Housing Impact Study for the Village of Cary Central Cary Tax Increment Financing District (TIF District #3). Copies of the documents can be obtained from the Village of Cary's website, www.caryillinois.com, or are available for inspection in the office of the Deputy Village Clerk located at the Cary Municipal Center, 755 Georgetown Drive, during regular business hours. Additional inquiries for further information regarding the proposed Central Cary Tax Increment Financing District shall be directed to the office of the Village of Cary's Community Development Director, Mr. Brian Simmons.

VI. Trustee Reports

Trustee McAlpine thanked Chief Finlon, Deputy Chief Naydenoff and Administrator Morimoto for hosting the candidates of the Miss Cary-Grove Business Leadership Pageant and providing training in self-defense.

VII. Consent Agenda

Motion:

I will entertain a motion to approve Consent Agenda Items A-Q as shown on the Village website and as displayed on the video monitor during the Village Board meeting.

Motion moved by Trustee McAlpine and motion seconded by Trustee Walrath. Motion Passed.

L. Consider for Approval a Resolution Approving a Contract for the 2023 Pavement Rejuvenation Program through the Lake-Cook County Municipal Partnering Initiative and Authorizing the Village Administrator to Execute a Contract with Corrective Asphalt Materials, LLC, South Roxana, Illinois, in an Amount Not to Exceed $25,000.00

M. Consider for Approval a Resolution Approving a One-Year Contract Extension for the 2023 Pavement Patching Program through the McHenry County Municipal Partnering Initiative and Authorizing the Village Administrator to Execute a Contract with Chicagoland Paving, Inc., Lake Zurich, Illinois, in an Amount Not to Exceed $60,000

N. Consider for Approval a Resolution Amending the Professional Services Agreement with Baxter & Woodman, Inc., Crystal Lake, IL to Extend Temporary Part-Time Municipal Engineering Services through September 30, 2023, or until the Village Deems Services No Longer Necessary in an Amount Not to Exceed $20,000

O. Consider for Approval a Resolution Approving a One-Year Contract Extension for the 2023 Bulk Rock Salt Joint Purchasing Bid through Lake County and Authorizing the Village Administrator to Execute a Contract with Morton Salt Company, Chicago, Illinois, in an Amount Not to Exceed $153,000.00 in FY2023- 24

P. Consider for Approval a Resolution Approving a Two-Year Extension of Baxter & Woodman (Crystal Lake, Illinois), Christopher B. Burke Engineering, Ltd. (Rosemont, Illinois), HDR (Rosemont, Illinois) and HR Green (McHenry, Illinois) as the Village's On-Call Engineering Services Consultants through April 30, 2025

Q. Consider for Approval a Resolution Approving a One-Year Contract Extension for the 2023 Parkway Tree Replacement Program and Authorizing the Village Administrator to Execute a Contract with Acres Group, Wauconda, Illinois, in an Amount not to Exceed $20,000.00

VIII. Items for Separate Action

A. Consider for Approval an Ordinance Granting Approval of a Conditional Use Amendment for a Cannabis Dispensary with Ancillary Infusion and Variances to the Screening Requirements along the Southern Property Line and Reduction in the Rear Building Setback to Zero Feet for the Property Located at 20 Northwest Highway

Director Simmons provided an overview of the proposed ordinance amendment.

Patrick Smith, counsel for Vertical Management, provided background on the requested ordinance amendment.

Trustee Dudek asked if the Board does not approve the amendment, will the dispensary be able to operate. Attorney Smith stated the dispensary could operate, however, they would only be able to sell products created offsite rather than bring in ingredients and create custom products onsite.

Motion:

Mayor Kownick entertained a motion to approve an ordinance granting approval of a conditional use amendment for a cannabis dispensary with ancillary infusion and variances to the screening requirements along the southern property line and reduction in the rear building setback to zero feet for the property located at 20 Northwest Highway.

Motion moved by Trustee Collier and motion seconded by Trustee McAlpine. Motion Passed.

B. Consider for Approval an Intergovernmental Agreement Between the Village of Algonquin, Village of Cary, Village of Lake in the Hills, City of McHenry and the County of McHenry Establishing the McHenry County Consolidated Law Enforcement Joint Training Facilities Chief Finlon provided an overview of the proposed intergovernmental agreement.

Trustee Collier asked what the procedure would be should additional municipalities want to participate in the use of these facilities.

Chief Finlon stated there would be a vote, and if passed, the cost for the existing partner municipalities would decrease as costs would be spread over more participants. Chief Finlon also stated specific law enforcement clients may be granted the ability to hold an event for a fee.

Motion:

Mayor Kownick entertained a motion to approve an intergovernmental agreement between the Village of Algonquin, Village of Cary, Village of Lake in the Hills, City of McHenry and the County of McHenry establishing the McHenry County Consolidated Law Enforcement Joint Training Facilities.

Motion moved by Trustee Walrath and motion seconded by Trustee McAlpine. Motion Passed.

IX. Administrator's Report

None.

X. Department Head Reports

Chief Finlon stated the Police Department held its semi-annual drug take back event on April 29th and collected 45lbs of unwanted prescription medication. Chief Finlon stated that over the past 6 months, the department has collected 163.6lbs of unwanted prescription medication through the drop box located in the Police Department lobby. Chief Finlon stated the Cary-Grove Youth Baseball & Softball parade has been rescheduled for May 7th at the same time and location as originally scheduled.

Assistant Village Administrator Sage stated the Village's Curbside Brush Pick-Up will take place for residents located south of the railroad tracks beginning the week of May 8th.

There being no further items to discuss, Mayor Kownick entertained a motion to adjourn the meeting at 7:08 p.m.
