City of Woodstock City Council met Oct. 3.

A regular meeting of the Woodstock City Council was called to order by Mayor Michael Turner at 7:00 PM on Tuesday, October 3, 2023, in the Council Chambers at Woodstock City Hall. He explained the Consent Calendar process and invited public participation. This meeting was livestreamed.
A roll call was taken.
COUNCIL MEMBERS PRESENT: Darrin Flynn, Melissa McMahon, Tom Nierman, Bob Seegers, Jr., Natalie Ziemba and Mayor Michael Turner.
COUNCIL MEMBERS ABSENT: Gordon Tebo.
STAFF PRESENT: City Manager Roscoe Stelford, Deputy City Manager/Executive Director of Strategy & Planning Paul Christensen, Executive Director of Business Development Danielle Gulli, Executive Director of Operations Christina Betz, City Engineer Chris Tiedt, Utilities Manager Mike Rousey, Grants Writer Barb Szul, Information Technology Director Dan McElmeel, Economic Development Director Garrett Anderson, Building & Zoning Director Joe Napolitano and Chief Deputy City Clerk Jane Howie.
OTHERS PRESENT: Former City Clerk Cindy Smiley, Mayor Emeritus Brian Sager and former City Manager Timothy Clifton, Arts Commission Member Anne Marie Whitmore Lenzini,
Chief Deputy Clerk Howie confirmed the agenda is a true and correct copy of the published agenda.
III. FLOOR DISCUSSION
A. Proclamation:
1. Retirement of Cindy Smiley
Mayor Turner asked Cindy Smiley, B. Sager, T. Clifton and City Manager Stelford to join him at the podium. He said what a great honor is was to welcome Ms. Smiley this evening and to recognize her contributions as City Clerk. Mayor Turner read the Proclamation for all to hear. The Proclamation was received with hearty applause,
Mayor Emeritus Sager commended Ms. Smiley for her professionalism, her integrity and most importantly her work as a true public servant. He added that her primary responsibility was to serve the people of this community, which she accomplished with much success. B. Sager added that during his working years with C. Smiley, he knew he could always count on her and her ability to be trusted. He thanked C. Smiley for her legacy.
Former City Manager Clifton shared his appreciation for C. Smiley over the years. He brought her some flowers and chocolates for her sweet tooth.
City Manager Stelford thanked C. Smiley for all the work she has done for him over the years. He shared his appreciation of her and her work.
Ms. Smiley shared that she was thrilled to have her family in attendance for this event. She thanked her family for all their support over the years. She talked about moving to Woodstock many years ago and how she chose to work for the City so that she could serve her community. She mentioned all the changes that have occurred over the years including the demolition of the Die Cast site and restoration of the Old Courthouse Ms. Smiley thanked Mr. Clifton, Dr. Sager, Mayor Turner and City Manager Stelford for saving the Old Courthouse. She thanked the City Council as well as former Councils for their service to the community. She mentioned many of the accomplishments she'd experienced over the years, and she also thanked the community for giving her the opportunity to serve and work for the City of Woodstock.
Mayor Turner said C. Smiley understands the pulse of the city and this community. He thanked her for her years of service.
2. Manufacturing Month
Mayor Turner read the Proclamation for Manufacturing Month for all to hear. Economic Development Director Garrett Anderson accepted the Proclamation on behalf of manufacturers. G. Anderson thanked Council for their support. He shared that Council has toured several manufacturing facilities with more tours in the future. He added that Woodstock has an excellent group of high-tech manufacturers.
B. Public Comment
There were no comments forthcoming from the Public.
C. Council Comment
Councilwoman McMahon stated, on behalf of Woodstock Pride, the group received the Governor's DEI (Diversity, Equity and Inclusion) Award (for population 25,000-75,000,) for the 2022 Woodstock Pride event. The event included numerous organizers, over 80 volunteers, many members of the City's staff and the Woodstock Area Chamber of Commerce. Councilman Flynn stated that it was his honor to speak on behalf of the City at the award ceremony. He added that the event was one of the most beautiful weekends in Woodstock.
IV. CONSENT AGENDA
Motion by Flynn, second by Ziemba to approve the Consent Agenda.
Councilwoman McMahon opined that there was a price discrepancy pertaining to Item D-5 on page 105 in the packet. She asked for clarification as it pertained to the wide range of pricing for the “all grading" (line item #2 of the bid tab) for the tennis courts. In response, City Engineer Tiedt said this cost is a lump sum cost and not a unit price cost. These are set costs and cannot change because they are lump sum and the bidders can't come back to request additional funding. He added that he has seen similar discrepancies with lump sum prices in a unit-price contract over the years on other projects. M. McMahon thanked C. Tiedt for the clarification.
Anne Marie Whitmore Lenzini thanked Mayor Turner for her nomination as Chairperson of the City's Arts Commission. She's looking forward to this opportunity.
Mayor thanked Ms. Whitmore Lenzini for her service and interest in arts in Woodstock.

1. Appointment of City Clerk - Consent of the Mayor's nomination of Jane Howie for appointment to the position of City Clerk effective immediately, due to the retirement of Cindy Smiley on September 20, 2023,
2. Appointments of Board and Commission Members - Consent of the Mayor's nominations for appointments to the City's Boards and Commissions, specifically appointing an existing member to Chair the Commission and two new members to serve on the Arts Commission to fill open vacancies.
3. Ordinance - B-2 Liquor License for Woodstock Food and Liquor - Approval of Ordinance 23-0-47, identified as Document #1, amending Section 3.3.6, Classification of Licenses; Number and Fees of the Woodstock City Code, to modify an existing Class B- 2 liquor license for new ownership and issue this license to SAI Krupa Enterprise, Inc., d/b/a Woodstock Food and Liquor with no change to the total number of licenses and contingent upon fulfillment of all requirements.
4. Ordinance - A-6 Liquor License for Duke's Inferno – Approval of Ordinance 23-0- 48, identified as Document #2, amending Section 3.3.6, Classification of Licenses; Number and Fees of the Woodstock City Code, for the creation of a new Class A-6 liquor license and issuance to Duke's Wood Fired Kitchen d/b/a Duke's Inferno and contingent upon fulfillment of all requirements.
5. Contract Award – Tennis Courts and Pickleball Courts - Approval of a contract for the full removal, replacement, and re-striping of tennis courts to include both tennis and pickleball courts at Emricson Park and Olson Park be awarded to the lowest responsible bidder, DK Contractors Inc, Pleasant Prairie, WI, for a total bid price of $751,343; and authorize the City Manager or his designee to execute a contract.
6. Contract Award - Leaf Disposal Services
Approval of a contract with Thelen Materials LLC, of Antioch IL, utilizing Home Rule authority and waiving of bids, for leaf disposal services for the 2023 season at a unit cost of $485 per hauled load; and authorize the City Manager or his designee to execute a contract.
7. Agreement – Legal Retainage for PFAS – Approval to authorize and designate David McArdle from Zukowski, Rogers, Flood, and McArdle (ZFRM), or his designee, to serve as the City's authorized representative and to retain Sher Edling LLP for matters related to PFAS Actions on behalf of the City in the manner described in the Legal Services Agreement, identified as Document #3.
8. Change Order Old Courthouse Center Access Control -
Approval of the two proposals submitted by Imperial Surveillance to automate locks in certain areas of the Old Courthouse Center and authorize the City Manager or his designee to execute contracts in the amount of $40,600 as well as authorize City Staff to work with qualifying electrical and elevator contractors for conduit installation and other installation expenses with an estimated cost of $5,000.
In response to a question from Mayor Turner, no items were pulled from the packet.
Mayor Turner affirmed the Consent Agenda to include items A - D-8.
A roll call vote was taken. Ayes: Flynn, McMahon, Nierman, Seegers, Ziemba, and Mayor Turner. Nays: none. Abstentions: none. Absentees: Tebo. Motion carried.
V. FUTURE AGENDA ITEMS
There were no additions, deletions, or corrections to the tentative future Council agendas.
VI. ADJOURN
Motion by Flynn, second by Nierman, to adjourn this regular meeting of the Woodstock City Council to the next regular meeting on Tuesday, October 17, 2023 at 7:00 PM in the Council Chambers at Woodstock City Hall.
Ayes: Flynn, McMahon, Nierman, Seegers, Tebo, Ziemba, and Mayor Turner. Nays: none. Abstentions: none. Absentees: none. Motion carried.
