Evidence presented at trial showed that on February 11, 2022, at approximately 9:30 PM, officers from the Algonquin Police Department were dispatched to a residence in Algonquin following a report of domestic battery. On arrival, officers met with Peter Garcia and the victim. During an argument, Garcia applied pressure to the victim’s neck, causing her to be unable to breathe. Officer Hopper from the Algonquin Police Department observed redness on the victim’s neck, consistent with her statements regarding Garcia’s actions.

Garcia faces between three and seven years in the Illinois Department of Corrections and may be subject to extended term sentencing of up to seven to fourteen years due to his criminal history. The sentencing will be carried out by the Honorable Mark Gerhardt on August 20, 2024.

The case was investigated by Officers Hopper and Gough from the Algonquin Police Department and prosecuted by Assistant State’s Attorneys Maria Marek and Brian Miller.
