Village of Johnsburg President and Board of Trustees met Aug. 20

Here are the minutes provided by the board:

President Hettermann called the meeting to order at 7:03 p.m. in the Village Hall.

AUDIENCE PARTICIPATION- Zolei Meyer of 3701 Fillmore attended to question why the Village prohibits the keeping of chickens on residential property. She submitted signatures of support from neighbors and asked what she can do to change the regulations. President Hettermann stated that the Village enacted an ordinance prohibiting chickens on residential property in 2013 because of complaints received. The matter came up again a couple of years ago in response to another complaint, which resulted in a resident petitioning the Village to change its ordinances. President Hettermann explained that much discussion took place over several meetings and the majority of the board again choose to prohibit them on residential property. He offered to provide Ms. Meyer information from those meetings.

OMNIBUS AGENDA - Trustee Fouke moved to approve the Omnibus Agenda. Trustee Hagen seconded the motion. All Trustees voted aye on the roll. Motion carried.

PRESIDENT’S REPORT - President Hettermann directed the Board members to inform Mr. Lamontagna if they will be in attendance at the Saufen und Spiel parade so that arrangements can be made for vehicles.

R & J LAND CORPORATION/PEASE AGREEMENT - Trustee Foreman moved to approve an Agreement by and between the Village of Johnsburg, R & J Land Corporation and Jack Pease. Trustee Letzte seconded the motion. All Trustees voted aye on the roll. Motion carried.

PAY ESTIMATE # 1 JOEL KENNEDY CONSTRUCTING CORP – Trustee Fouke moved to approve Pay Request #1 in the amount of $34,020 to Joel Kennedy Constructing Company for the River Sewer Crossing Project. Trustee Letzter seconded the motion. All Trustees voted aye on the roll. Motion carried.

RIVER SEWER CROSSING EXTENSION OF COMPLETION DATE – Trustee Letzter moved to approve request for extension in substantial completion date for the River Sewer Crossing Project to December 31, 2024. Trustee Fouke seconded the motion. Mr. Hartnett explained that some delays were experienced in receiving materials for the project and acquiring the McDot permit. All Trustees voted ay on the roll. Motion carried.

RIVER SEWER CROSSING CHANGE ORDER – Trustee Letzter moved to approve a change order in the amount of $575 to increase the size of the wet well hatch for the River Sewer Crossing project.

Trustee Fouke seconded the motion. All Trustees voted aye on the roll. Motion carried.

ORDINANCE 24-25-06 AMENDING THE CONDITIONAL USE PERMIT FOR PLANNED DEVELOPMENT FOR DUTCH CREEK ESTATES PHASES 3, 4, AND 5. Trustee Foreman moved to approve Ordinance 24-25-06 Amending the Conditional Use Permit for Planned Development for  Dutch Creek Estates Subdivision Phases 3, 4, and 5. Trustee Fouke seconded the motion. All Trustees voted aye on the roll. Motion carried.

STRATEGIC PLANNING REPORTS – Trustee Foreman reported that the Brorson property has been published for bids. Trustee Fouke reported that Celebration in the Park will be held on September 21st this year due to a change in the date for Homecoming and the Community Affairs Committee has secured Thompson Duo for the entertainment. Discussion was had regarding establishing a consistent date each year for the event.

Trustee Hagen reported that a couple calls have taken place with Revise to begin designing the Village’s new website. To date much of the focus has been on the site’s design and sitemapping At the current time it is anticipated that the website will go live by February.

Trustee Fouke discussed non-highway vehicle road crossings. It was noted that a crossing is identified at Meadow Lane on the City of McHenry’s non-highway vehicle map.

Trustee Foreman suggested that the Village consider adopting a tree preservation ordinance which would regulate when oak trees can be trimmed. She referenced an incident that occurred in her neighborhood with Asplund when they were out trimming oak trees out of season for Com Ed. Attorney Smoron suggested the Village reach out to Bull Valley as they came to a policy agreement with Com Ed regarding their tree trimming.

RECESS FOR CLOSED SESSION – Trustee Morris moved to recess to go into closed session to discuss the appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the Village. Trustee Klemstein seconded the motion. All Trustees voted aye on the roll. Motion carried at 7:43 p.m.

RETURN TO REGULAR SESSION – Trsutee Letzter moved to return to regular session. Trustee Foreman seconded the motion. All Trustees voted aye on the roll. Motion carried at 8:53 p.m.

MOTIONS FOLLOW EXECUTIVE SESSION - Trustee Foreman moved to approve Fiscal Year 2025 wages and bonuses. Trustee Letzter seconded the motion. All Trustees voted aye on the roll. Motion carried.

ADJOURNMENT – Trustee Morris moved to adjourn the meeting. Trustee Klemstein seconded the motion. All Trustees voted aye on the roll. Motion carried at 8:54 p.m.
