1. Call meeting to order

4. Public Comment
The public is invited to make an issue-oriented comment on any matter of public concern not otherwise on the agenda. Individuals wishing to address the City Council are invited to come forward to the podium and be recognized by the Mayor; provide their name and address for purposes of the record, if willing to do so. Public comment is restricted to no longer than 3 minutes in duration. Interrogation of the City staff, Mayor or City Council will not be allowed at this time, nor will any comment from the Council. Personal invectives against City staff or elected officials are not permitted.

Items under the Consent Agenda are acted upon in a single motion. There is no separate discussion of these items prior to the Council vote unless a Council Member or member of the public requests that an item be removed from the consent agenda for separate action.

10. Planning & Zoning Commission’s recommendation regarding UDO Text Amendments
● Recommendation: “Motion to Adopt the Proposed Ordinance Amending 8.2 Use Matrix to include Cannabis Dispensary and Cannabis Craft Grower as permitted use in the M-1 Zoning District and Banquet Hall as a Conditional Use in the M-1 Zoning District.”
11. Community & Economic Development Committee Recommendation - UDO Text AmendmentAnti-Monotony Provisions
● Recommendation: “Motion to submit to the builder-friendly anti-monotony regulations to the Planning & Zoning Commission for consideration”.
12. Proposed Tax Levy Ordinance
● Recommendation: “Motion to adopt the proposed Tax Levy Ordinance.”
13. Proposed Tax Levy Abatement Ordinance
● The abatement is meant for those revenue bonds issued for the water system and TIF District.
Pledged revenues are sufficient to pay for the principal and interest. Recommendation:
“Motion to adopt the proposed Tax Levy Abatement Ordinance”.
14. Infrastructure Committee Recommendation- Grease Trap Ordinance
● Recommendation: “Motion to adopt the proposed ordinance amending Section 13A.06, regarding Grease Oil, and Sand Interceptors.”

● Recommendation: “Motion to adopt the proposed ordinance amending Section 13A.15 regarding wastewater penalties”

23. Administration Committee Recommendation – New Development Agreement with Holcim
● Recommendation: “Motion to approve the Mayor and City Administrator to continue negotiations on a draft agreement, including a tolling agreement if needed.”
24. Administration Committee Recommendation – Amend the FY2024/2025 Budget relating to the Compensation Study, Police Pension, MFT Grant Revenue and MFT Maintenance Expense
● Recommendation: “Motion to adopt the proposed ordinance amending the FY2024/2025 Budget.
25. Infrastructure Committee Recommendation - Pavement Coring-Engineering Services from Midland Standard Engineering & Testing, Inc.
● Recommendation: “Motion to approve proposed work by MSET (Midland Standard Engineering & Testing, Inc.) to assess the condition of existing residential street pavements, including 90 pavement cores with shallow depth subgrade probes for a total of $29,970.”
26. Infrastructure Committee Recommendation - Proposal for Professional Engineering Services from Christopher B. Burke Engineering for a Citywide Road Rehabilitation Study
● Recommendation: “Motion to approve Christopher B. Burke Engineering Plan for Professional Engineering Services for a Citywide Road Rehabilitation Study for a total of $28,228.”
27. Infrastructure Committee Recommendation - Starbucks Deferral of Sidewalks
● Recommendation: “Motion to approve a 5-year sidewalk deferral and accept a Letter of Credit in the amount of $69,928.07, which will be used for the installation of sidewalks for the Starbucks project, deferring the installation of sidewalks on Route 14 and McGuire for a period not to exceed 5 years.”
