CALL TO ORDER: 

A meeting of the Huntley Liquor Commission was called to order on Thursday, June 8, 2023 at 7:00 p.m. in the Municipal Complex, Village Board Room, 10987 Main Street, Huntley, Illinois 60142.

ATTENDANCE: 

PRESENT: Chairman Timothy Hoeft; Commissioner: Vito Benigno, Ronda Goldman, Mary Holzkopf, John Piwko, Ric Zydorowicz

ABSENT: CommissionerJR Westberg

Chairman Hoeft stated the Agenda needed to be amended removing Item D: Ordinance Amending the Huntley Code of Ordinances – Business Regulations, Alcoholic Beverages Chapter 110 Section 110.24 − Limitation on Licenses − Adding One Class “A” License and Issuing a Class “A” Liquor License to Lagos Pizzeria Inc., d/b/a Papa Saverio’s Pizzeria, 12070 Princeton Drive; this agenda item will come back before the Board at a future date.

A. Consideration ‐ Approving an Ordinance Issuing a Class "E" Liquor License and Waiver of Fee for Animal House Shelter, Inc. Pawfest Event at Deicke Park, August 12, 2023

A MOTION was made to approve an Ordinance issuing a Class "E" Liquor License and Waiver of Fee for Animal House Shelter, Inc. Pawfest Event at Deicke Park, August 12, 2023: 

1. Petitioner must provide all applicable documents required by the Village of Huntley Code of Ordinances.

2. Petitioner must show proof of the State of Illinois Liquor License before the Village of Huntley Class “E” Liquor License becomes effective.

B. Consideration ‐ Ordinance Amending the Huntley Code of Ordinances ‐ Business Regulations, Alcoholic Beverages Chapter 110 Section 110.24 ‐ Limitation on Licenses ‐ Adding One Class "A" License and Issuing a Class "A" License to Lincoln House & Co., 11808 Main Street

The Village regulates the sale of alcoholic beverages through its Liquor Control Ordinance, which provides for the issuance of certain classes of liquor licenses and establishesthe number of licenses available in each class. The Village is in receipt of an application from the owners of Lincoln House & Co. for a Class “A” liquor license for 11808 Main Street. Lincoln House & Co. will operate as a wine and coffee bar with limited food offerings. A Class “A” license permits the retail sale on the premises specified, of alcoholic liquor, for consumption on the premises, as well as other retail sale of alcoholic liquor in the original package.

Staff Analysis 

Consideration is requested to amend Section 110.24 of the Code of Ordinances to increase the number of available Class “A” licenses from 17 to 18 in order to issue a liquor license to Lincoln House & Co. Outside seating is planned on the west side of the building on private property that is leased by the Village and would be considered part of the premises. The lease forthe property includesthe serving and consumption of alcohol as a permitted activity.

If approved, the request is subject to the following conditions:

1. All requirements of the Village of Huntley Liquor Control Ordinance shall be in compliance prior to the liquor license becoming effective.

2. Petitioner must show proof of the State of Illinois Liquor Licenses before the Village of Huntley Class “A” Liquor License becomes effective.

2022‐2025 Strategic Plan Alignment 

The Strategic Plan identifies “Strong Local Economy” as a strategic focus and the following goals: “Location of Choice for New and Expanding Businesses of all Sizes,” and “A Vibrant Downtown Gathering Place.” Additional commercial development in the downtown enhances its location as a gathering place and reinforces the economic vitality of the area.

Financial Impact 

The fee for a Class “A” License is $1,500.00.

Legal Analysis 

Section 110.24 of the Code of Ordinances limits the number of available licenses in each class. There is no available Class “A” license. Therefore, if the Liquor Commission approves the request from the applicant, the code must be amended to create one additional Class “A” license.

A motion of the Liquor Commission to Approve an Ordinance Amending the Huntley Code of Ordinances – Business Regulations, Alcoholic Beverages, Chapter 110, Section 110.24 – Limitation on Licenses, Adding one Class “A” License to Lincoln Coffee House & Company d/b/a Lincoln House & Co., 11808 Main Street.

C. Consideration ‐ Ordinance Amending the Huntley Code of Ordinances ‐ Business Regulations, Alcoholic Beverages Chapter 110 Section 110.24 ‐ Limitation on Licenses ‐ Adding One Class "A" License and Issuing a Class "A" Liquor License to DC Cobbs, Huntley, 11808 Coral Street, and a Class "I" Caterer License

Village Manager David Johnson stated the Village regulates the sale of alcoholic beverages through its Liquor Control Ordinance, which provides for the issuance of certain classes of liquor licenses and establishes the number of licenses available in each class. The Village is in receipt of an application from the owner of DC Cobbs, Huntley for a Class “A” liquor license for 11808 Coral Street, as well as a Class “I” caterer license. A Class “A” license permits the retail sale on the premises specified, of alcoholic liquor, for consumption on the premises, as well as other retail sale of alcoholic liquor in the original package.

A Class “I” shall be issued only to a business that is a caterer‐retailer and who presently holds a Class “A”, “B”, “C”, or “F” liquor license issued by the Village and which authorizesthe sale and delivery of alcoholic beverages by the drink for consumption either on site at the licensed premises, or off site. The licensed premises shall be considered the primary place of business of the catering business and all sales of alcoholic beverages made pursuant to the Class “I” license shall be deemed to have been made at the premises licensed by the primary license issued by the Village. The Redevelopment Agreement for the Coral Street Firehouse project acknowledges the applicants plan to apply for a liquor license.

Staff Analysis 

Consideration is being requested to amend Section 110.24 of the Code of Ordinances to increase the number of available Class “A” licenses from 18 to 19 in order to issue a liquor license to DC Cobbs Restaurant. Outside seating, considered part of the premises, is included in the patio area adjacent to Coral Street. If approved, the request is subject to the following conditions:

1. All requirements of the Village of Huntley Liquor Control Ordinance shall be in compliance prior to the liquor license becoming effective.

2. Petitioner must show proof of the State of Illinois Liquor Licenses before the Village of Huntley Class “A” Liquor License becomes effective.

There being no further businessto discuss, a motion was made at 7:07 p.m. to close the Liquor Hearing. MOTION: Commissioner Piwko

The Voice Vote noted all ayes and the motion carried.
