Village of Cary Board of Trustees met Oct. 3.

ATTENDANCE

Village Board of Trustees

Mayor Mark Kownick, Trustee Dale Collier, Trustee Rick Dudek, Trustee Ellen McAlpine, Trustee Anthony Stefani, Trustee Rick Walrath (virtual), Trustee Jennifer Weinhammer

Others Present

Village Administrator Morimoto, Assistant Village Administrator Sage, Community Development Director Simmons, Public Works Director Noonan, Police Chief Finlon, Deputy Public Works Director Stein, Village Attorney Uhler

I. Call to Order

The meeting was called to order by Mayor Kownick at 6:01 p.m.

II. Roll Call

The roll was called and all were present.

Motion: Mayor Kownick entertained a motion to allow Trustee Walrath to attend the meeting via teleconference.

Motion moved by Trustee McAlpine and motion seconded by Trustee Stefani. Motion Passed.

AYES: Collier, Dudek, McAlpine, Stefani

NAYS: None.

ABSTAIN: None.

III. Pledge of Allegiance

Mayor Kownick led in the recitation of the Pledge of Allegiance.

IV. Open Forum

Jo Roberts, 42 Timber Terrace, stated she would like additional information regarding fees for a building permit she recently received.

Village Administrator Morimoto stated he will work with Director Simmons to investigate the issue and will follow up with Ms. Roberts.

There being no further comments, Mayor Kownick closed Open Forum at 6:13 p.m.

V. Mayor's Report

A. Proclamation - National Fire Prevention Week - October 8-14, 2023, "Cooking Safety Starts With YOU. Pay Attention To Fire Prevention."

Mayor Kownick proclaimed October 8-14, 2023, as National Fire Prevention Week.

B. Employee Recognition - Chris Winkelmann, Police Department, Retirement

Mayor Kownick and the Village Board recognized Deputy Chief Chris Winkelmann on his 20 years of service and congratulated him on his retirement.

Motion: I will entertain a motion to approve Consent Agenda Items A-D as shown on the Village's website and as displayed on the video monitor during the Village Board meeting.

Motion moved by Trustee McAlpine and motion seconded by Trustee Stefani. Motion Passed.

A. Consider for Approval the Warrant Dated October 3, 2023

B. Consider for Approval the September 19, 2023, Village Board Meeting Minutes

C. Consider for Approval the September 19, 2023, Committee of the Whole Meeting Minutes

D. Consider for Approval an Ordinance Granting Approval of a Final Plat of Subdivision for the East Cary Commercial Subdivision Phase 2

VIII. Items for Separate Action

A. Consider for Approval a Waiver of Certain Application Requirements for a Planned Development Application Related to the Development of the Property Located on the Southeast Corner of Hickory Nut Grove Lane and South Rawson Bridge Road Director Simmons provided an an overview and update regarding the proposed development.

James Gray of Treeline Partners, LLC, provided an overview of his proposed development and stated he was welcome to preliminary feedback from the Village Board.

Mayor Kownick stated he supports the project; however, he has a concern related to the dedication of the right-of-way and future confusion with roadway maintenance. Mayor Kownick stated he has concerns with granting some of the proposed waivers.

Trustee Dudek stated he hoped that more information could have been provided to better make a decision, but was overall welcoming of the project.

Trustees Collier and McAlpine support the project but do not feel the information. presented is sufficient to grant the requested waivers.

Trustee Walrath supports the project but does not feel the information presented is sufficient to grant the requested waivers. Trustee Walrath feels the application requirements are critical for the success of the project.

Mr. Gray stated he appreciates the feedback from the Village Board. Mr. Gray asked the Board to indicate if they have any significant issues with the proposed project, specifically related to the site plan.

Mayor Kownick stated he is very supportive of offering this type of housing in Cary.

Trustee Dudek asked if the sidewalk extension previously discussed by the Board along South Rawson Bridge Road would connect with the sidewalk shown in the preliminary site plan.

Director Simmons stated as part of the annexation of this parcel, improvements would be required so the sidewalks related to this project would coordinate with the sidewalk extension along South Rawson Bridge Road.

Director Simmons stated as part of the annexation, the right-of-way of Hickory Nut Grove Lane will need to come under the jurisdiction of the Village. Director Simmons stated that this process might require the road to be widened or resurfaced to meet Village standards.

Mr. Gray stated they will probably request to enact more than one SSA for the project.

Motion: I will entertain a motion to approve a waiver of certain application requirements for a planned development application related to the development of the property located on the southeast corner of Hickory Nut Grove Lane and South Rawson Bridge Road.

Motion moved by Trustee Collier and motion seconded by Trustee McAlpine. Motion Failed.

IX. Administrator's Report

None.

X. Department Head Reports

Chief Finlon stated the Police Department will be hosting Coffee With A Cop on October 4th from 9:00-11:00 a.m. at Eggville Cafe.

Director Noonan stated curbside brush pick-up and hydrant flushing programs are underway. Director Noonan stated a new detour will be in place as the contractors switch work to the opposite side of the W. Main Street.

XI. Future Agenda Items and Discussion by Village Board

None.

XII. Adjourn

Motion: There being no further items to discuss, Mayor Kownick entertained a motion to adjourn the meeting at 6:56 p.m.

Motion moved by Trustee McAlpine and motion seconded by Trustee Stefani. Motion Passed.
