Village of Huntley Village Board and Liquor Commission met Jan. 25.

Here are the minutes provided by the commission:

CALL TO ORDER: 

A meeting of the Village Board and Liquor Commission of the Village of Huntley was called to order on  Thursday, January 25, 2024 at 7:00 p.m. in the Municipal Complex, Village Board Room, 10987 Main St., Huntley, Illinois 60142. 

ATTENDANCE: 

PRESENT: Village President Timothy Hoeft; Trustees: Ronda Goldman, Mary Holzkopf, John Piwko, JR Westberg, and Ric Zydorowicz 

ABSENT: Trustee Vito Benigno 

IN ATTENDANCE: 

Village Manager David Johnson, Deputy Village Manager Lisa Armour, Director of Public Works and Engineering Tim Farrell, Deputy Director of Public Works and Engineering Jason Irvin, Director of Human Resources and Organizational Compliance Chrissy Hoover, and Communications and Compliance Manager Sarah Palaszewski. 

PLEDGE OF ALLEGIANCE: Boy Scout Pack #167 of Huntley led the Pledge of Allegiance.

PUBLIC COMMENTS: None 

PUBLIC HEARING: 

5.1 Public Hearing – Maintenance Special Service Area for the Fieldstone Subdivision, Generally Located on the North Side of Huntley-Dundee Road Between Ruth Road and Haligus Road 

A MOTION was made to open the Public Hearing at 7:02 p.m.  

MOTION: Trustee Westberg 

SECOND: Trustee Holzkopf 

AYES: Trustees: Goldman, Holzkopf, Piwko, Westberg, and Zydorowicz  

NAYS: None 

ABSENT: Trustee Benigno 

The motion carried: 5-0-1 

Village President Hoeft asked if the public had any comments related to the Public Hearing; there were none.

A MOTION was made to close the Public Hearing at 7:03 p.m.  

MOTION: Trustee Zydorowicz

AYES: Trustees: Goldman, Holzkopf, Piwko, Westberg, and Zydorowicz  

NAYS: None

SPECIAL RECOGNITION: 

6.1 Recognition of Service – Jim Schwartz  

Village Manager David Johnson recognized Jim Schwartz, longtime Public Works employee, for his 31+ years of service. Mr. Schwartz started with the Village in 1992 and spent 24 years as Director of Public Works. In 2016, shortly after retiring, Mr. Schwartz returned to the Village as a part-time employee. Village Manager Johnson acknowledged his many contributions to the Village and thanked him. Director of Public Works and  Engineering Tim Farrell reviewed a presentation that shared the career highlights of Mr. Schwartz. He stated  Mr. Schwartz will be greatly missed and thanked him for all he has done. The Village presented Mr. Schwartz with a street sign sharing that the access road to the Public Works facility will be named “Jim Schwartz Way.”  The Village also presented Mr. Schwartz with a plaque acknowledging his contributions to the community;  the plaque will be placed outside of the Public Works Building. Mr. Schwartz thanked the Village Board, Staff, and his family for all their support over the years.  

Village President Hoeft and the Board of Trustees thanked him for all he has done for the Village and adapting  to the growth of the community by continuing to provide quality services. 

LIQUOR COMMISSION: 

7.1 Consideration – Ordinance for the Approval and Issuance of a Class “E” Liquor License and Waiver of Fee for St. Mary Catholic Church, 10307 Dundee Road - 2024 Parish Summer Fest August 10, 2024 

Liquor Commission Chairman Hoeft stated St. Mary Catholic Church (Church) is requesting a Class “E” Liquor  License to sell beer and wine only for the Parish Summer Fest taking place on church property on August 10, 2024. Pursuant to the Village of Huntley Liquor Control Ordinance, a Class “E” Liquor License is a temporary license, not to exceed three days, issued to not-for-profit organizations with a license fee of $75.00. The Class “E” license authorizes the retail sale of beer and wine or other alcoholic liquor specifically approved at  the time of license application for consumption upon the premises where sold or offered as specified in the license. No Class “E” license shall be issued until the Liquor Commission has: 

1. Established the location upon the premises where beer and wine, or other approved alcoholic liquor is to be sold; 

2. The hours of operation, which shall not be extended beyond those provided in §110.09; 

3. The manner in which the licensee will manage crowd control and refuse pickup; 

4. Proof of insurance as required by this chapter or state laws; 

5. A list of members of the corporation who will be selling beer and wine or other approved alcoholic liquor, at the location pursuant to the license; and 

6. Proof of permission from the owner of the premises authorizing the sale of beer and wine or other approved alcoholic liquor, during the time requested in the permit and such other requirements as the President and Village Board or Liquor Control Commission deem appropriate in the case of each  particular permit. 

STAFF ANALYSIS 

The Church is requesting the license to operate a beer garden for one day only during the hours of 12:00  p.m. to 8:00 p.m. with serving ending at 7:30 p.m.  

The beer garden area will be fenced off and no alcohol will be removed from this area. The tent being used  for the beer garden is 60’ x 110’. Servers will be all members of the Knights of Columbus, have been BASSET trained and will be the only members to perform the ID check to provide a wrist band and serve the alcohol.

An application has been placed on file and reviewed by the Village. The application is being presented with  the provision of the State license being provided. All other required documentation has been submitted and meets code requirements. 

FINANCIAL IMPACT 

St. Mary Church is requesting waiver of the $75.00 permit fee. The Commission has waived the fee in the  past. 

LEGAL ANALYSIS  

Section 110 of the Village Code of Ordinances regulates liquor sale in the Village. The application has been reviewed and is in compliance with Section 110: Alcoholic Beverages requirements 

ACTION REQUESTED  

A motion of the Liquor Commission is requested by the petitioner for an Ordinance Approving the issuance of a Class “E” Liquor License to St. Mary Catholic Church for the 2024 St. Mary Parish Summer Fest on August 10, 2024 and Waiver of Fees subject to the following conditions of approval: 

1. A Temporary Use Permit must be applied for and obtained from the Development Services Department. 

2. A Temporary Sign Permit must be applied for an obtained from the Development Services Department. 

3. The approved alcohol can only be sold and consumed in the designated beer garden area.

4. Anyone serving or selling alcohol must be BASSET trained. 

5. No less than one (1) week prior to the event: 

6. Petitioner must show proof of the State of Illinois Liquor License before the Village of Huntley Class “E” Liquor License becomes effective. 

Chairman Hoeft asked if the Liquor Commission had any comments or questions; there were none.

7.2 Consideration – Ordinance Amending the Huntley Code of Ordinances – Business Regulations, Alcoholic Beverages Chapter 110 Section 110.24 − Limitation on Licenses − Adding One Class “A” License and Issuing a Class “A” Liquor License to Tacos Jerez, 12262 Route 47 

Liquor Commission Chairman Hoeft stated the Village is in receipt of an application from the owner of Tacos Jerez for a Class “A” liquor license for 12262 Route 47 (former Burger King building). A Class “A” license permits the retail sale on the premises specified, of alcoholic liquor, for consumption on the premises, as well as other retail sale of alcoholic liquor in the original package.  

STAFF ANALYSIS 

Consideration is being requested to amend Section 110.24 of the Code of Ordinances to increase the number  of available Class “A” licenses from 20 to 21 in order to issue a liquor license to Tacos Jerez Restaurant. If  approved, the request is subject to the following conditions: 

1. All requirements of the Village of Huntley Liquor Control Ordinance shall be in compliance prior to  the liquor license becoming effective. 

2. Petitioner must show proof of the State of Illinois Liquor Licenses before the Village of Huntley Class “A” Liquor License becomes effective. 

3. No liquor sales are permitted through the drive-through window. 

2022-2025 STRATEGIC PLAN ALIGNMENT 

The Strategic Plan identifies “Strong Local Economy” as a strategic focus and the following goal: “Location  of Choice for New and Expanding Businesses of all Sizes.” Tacos Jerez is a new business in the Village of  Huntley.  

FINANCIAL IMPACT 

The fee for a Class “A” License is $1,500.00.  

LEGAL ANALYSIS 

Section 110.24 of the Code of Ordinances limits the number of available licenses in each class. There is no available Class “A” license. Therefore, if the Liquor Commission approves the request from the applicant, the code must be amended to create one additional Class “A” license.  

ACTION REQUESTED 

A motion of the Liquor Commission to Approve an Ordinance Amending the Huntley Code of Ordinances – Business Regulations, Alcoholic Beverages, Chapter 110, Section 110.24 – Limitation on Licenses, Adding one  Class “A” License and Issuing a Class “A” Liquor License to Tacos Jerez, 12262 Route 47.

Commissioner Piwko inquired on the opening date for Tacos Jerez. Petitioner Esai Esqueda, owner of Tacos Jerez, stated they hope to open in the next month.  

Trustee Holzkopf reminded the petitioner that their liquor license does not permit liquor sales through the  drive-thru.

8.8 Consideration – Resolution Authorizing the Purchase of Three Ford Escapes from Currie Motors through the Northwest Municipal Conference (NWMC) Suburban Purchasing Cooperative for $90,138.00 for the Police Department 

Village President Hoeft asked if the Village Board had any comments or changes to the Consent Agenda; there were none.

ITEMS FOR DISCUSSION AND CONSIDERATION: None 

VILLAGE ATTORNEY’S REPORT: None 

VILLAGE MANAGER’S REPORT: Village Manager Johnson stated that the 2024 Budget-in-Brief documents were distributed to the Board.  

VILLAGE PRESIDENT’S REPORT: Village President Hoeft shared that Trustee Benigno’s birthday is January 26th and wished him a happy early birthday. Village President Hoeft shared that the next Village  Board Meeting will be on Thursday, February 8th.  

Village President Hoeftshared that the Village has received compliments from the community on the quality of snow removal during the recent snow storm that resulted in 11 inches of snow. However, there were complaints related to non-Village owned roads and side streets. Unfortunately, the Village does not have ownership of those roads and therefore does not remove the snow from those roads. Public Works  continued to remain committed to providing quality service to the community.
